General Release Form
On this __________ day of ____________________, 200_____, intending to be legally bound hereby, the undersigned, for himself/herself, his/her personal representatives, heirs and next of kin, agrees and does hereby release from liability and to indemnify and hold harmless EngineLogics INC., its parent corporation, subsidiaries, officers, directors, promoters, sponsors, and any of its employees or agents representing or related to the Corporation of all liability to the undersigned, whether caused by the negligent act or omission of releasees or otherwise as regards to any modifications performed on the undersignedÂ’s vehicle. It is fully understood by each of the undersigned that there is some inherent risk associated with modifying their vehicle, including damage to vehicle. IN ADDITION, the undersigned AGREES TO INDEMNIFY AND HOLD HARMLESS the releasees from any loss, liability, damage, or cost they incur due to subsequent usage of said vehicle by the undersigned, and any passengers (including minors) whether caused by releaseesÂ’ negligence or otherwise, and AGREES TO ASSUME FULL RESPONSIBILITY AND RISK for any bodily injury, death, or property damage from releaseesÂ’ negligence or otherwise while the undersigned us operating the vehicle. In signing this release, each of the undersigned hereby acknowledges and represents that he or she has read the foregoing Release and Waiver of Liability and Indemnity Agreement; and understands that he/she is assuming liability and indemnifying as to any damage. This release is for any and all liability for personal injuries (including death) and property losses or damage occasioned by, or in connection with any usage of the vehicle.
All products sold or installed or modified by EngineLogics INC. are intended for high performance, racing, and off-road use only. Due to the nature of such parts, the unusual stresses placed upon them, and the fact that we cannot control how they are installed or used; there is no warranty of any kind on any EngineLogics INC. product or service. EngineLogics INC. expressly disclaims any warranty, either expressed or implied, including all warranties of merchantability or fitness for a particular purpose. EngineLogics INC. also disclaims any other obligation or liability as a result of products sold and/or installed or any service provided. No representations have been or will be made to the buyer regarding EngineLogics INC. products, including, but not limited to, their quality or performance. EngineLogics INC. shall not be held liable for any damages caused by a defect or failure of parts manufactured, sold, and/or installed. The corporation shall not be responsible for any damages, consequential or otherwise, arising from any cause whatsoever. EngineLogics INC. will not be responsible for labor, transportation, or any other related costs incurred as a result of any part failure or defect. If at any time EngineLogics INC. requires the services of an attorney, whether legal action be brought or not, the buyer agrees to pay all costs involved, including, but not limited to, court costs and attorney fees.
The installation or modification of any product sold by EngineLogics INC. on any vehicle intended for use on public roads may violate certain U.S. and/or State laws or regulations , including those relating to motor vehicle safety and emissions standards. The purchaser assumes all risks and expenses relating to unlawful vehicle operation on public roads. EngineLogics INC. shall not be held liable for unlawful vehicle operation.
EngineLogics INC. is not responsible for any damages to persons and/or property while located at our facility or while under the care or direction of authorized employees or agents of the company. EngineLogics INC. along with its employees or agents, will not be held liable for damages, consequential or otherwise, to vehicles left at our facility or under our care and/or operation. It is the responsibility of the customer and/or vehicle owner to maintain adequate insurance coverage while the vehicle remains at our facility or under our care. The company is not responsible for acts of vandalism, theft, weather, fire, or any other reason that may cause damage to a customer vehicle. In the course of executing a work order, it may be required to test drive customer vehicles. It is the responsibility of each customer to maintain valid and current State registration and inspection documentation for the vehicle when under the care of EngineLogics INC.. Proof of such registration and inspection must be kept with the vehicle at all times, along with valid proof of adequate insurance. The customer will be responsible for payment of any fines, fees, or legal costs incurred as a result of failure to maintain current insurance coverage, State registration, or vehicle inspections for the vehicle.
Each and every customer of EngineLogics INC., voluntarily makes and grants this waiver and assumption of risk in favor of EngineLogics INC.. for the opportunity to utilize the facilities, equipment, materials, and any other asset of the company; and/or to engage in activities or gatherings sponsored by the company; and/or to utilize the labor and materials supplied by EngineLogics INC. for use in a motor vehicle. The customer will hereby waive and release any and all claims whether in contract or of personal injury, bodily injury, property damage, damages, losses, and/or death that may arise from aforementioned use or receipt. Customer understands and recognizes that there are certain risks, dangers, and perils connected with the installation and use of high performance, racing, or off-road parts. It is fully acknowledged that these risks are understood at the time of purchase.
